The questions dentists actually ask
- Does this make my practice liable under HIPAA?
- No, and it is built specifically so it cannot. The patient uses Smyly on their own phone, on their own initiative. The photo never touches your systems and it never reaches you. You receive a name and a phone number only when a patient explicitly asks you to contact them. Smyly is not your business associate, and you do not need a BAA with us. The one thing that would change that: staff taking a patient's photo on a practice device. Don't do that, and your MSA will say so.
- Do I get to see the patients' photos or previews?
- No. There is no gallery, for anyone, including us. The patient owns their preview. If they want to show you, they read you a six-character code and you open it on your screen, and even then you see the simulation, never their original photo. That boundary is deliberate and it is what keeps this simple for both of us.
- How accurate are the previews?
- They are AI simulations, not clinical predictions, and every single one is labelled that way to the patient. They are a conversation starter, not a treatment plan. A preview cannot see bone, occlusion, or gum health, and we say so on the screen, in the email, and on the poster. Anyone selling you AI dentistry that promises outcomes is selling you a lawsuit.
